Court rejects bail plea of drug peddlers..

A local court here on Friday rejected bail plea of two alleged peddlers, saying that it will ‘hamper the investigation’.
After hearing defence counsel and additional public prosecutor Bilquees Mushtaq Zargar, the court of 3rd additional sessions Judge, Srinagar, Mehmood Ahmed Choudhary said that the accused cannot be released on bail at this point of time “as it will hamper the investigation.”
The court added that the investigation of the case is going on and the forensic report is still awaited.
According to the prosecution, accused Mohsin Ahmed Dar and Javaid Ahmed Khan – both residents of Srinagar city – had committed the offences under section 8/12 of the NDPS act.
Earlier, additional Public prosecutor, Bilquees Mushtaq Zargar told the court that the allegations were grave in nature.
“The contraband seized from the possession of the accused is of commercial nature and as such they cannot claim bail as a matter of right,” she added.
She submitted that the persons involved in this heinous trade need to dealt with iron hand for the larger interest of the society. “They cannot be let free as it concerns our children and youth who are already under the garb of deadly addiction. So this application needs to be rejected,” she added.
The counsel representing the accused submitted that the mere possession of the recovery doesn’t entitle the applicants to be guilty. He told the court that the accused are “innocent” and that they have every right to be set free on bail.
According to the case dairy, Mohsin Ahmed Dar of Chattabal tried to flee after seeing a police party at Kuman post on 5 January 2018.
It said that the accused moving under “suspicious circumstances” was carrying a bag. However, he was “tactfully” apprehended by the police personnel.
“During search operation, 35 bottles of cough syrup bottles were recovered from his possession,” it added.
Accordingly an FIR 8/21 under NDPS act was registered against the accused at PS Batmaloo
