Defending 35(A) is the touchstone, Article 370 anyways is unassailable’

The government of India’s assertion in Parliament that it would not abrogate Article 370 binds it now to defend Article 35A in the Supreme Court, Peoples Democratic Party (PDP) said on Tuesday.
Speaking in Lok Sabha, Union minister for home Hansraj Gangaram Ahir said the government of India currently has no proposal under consideration to scrap Article 370.Commenting on the development, PDP chief spokesperson Muhammad Rafi Mir said, “This now makes it obligatory on the Centre to support state government’s stand on Article 35A in the Apex Court.”
“The minister’s statement has vindicated our stand that the state government is serious about protection of state’s interests,” he added.
While Article 370 guarantees special status to J&K, the Article 35A empowers the J&K legislature to define permanent residents of the state. This provision was added to the constitution through the Constitution (Application to Jammu and Kashmir) Order, 1954, issued by country’s first president Rajendra Prasad on 14 May 1954 in exercise of the powers conferred by clause (1) of Article 370.
