Counsel for complainant in the case involving army Major Leetul Gogoi, who was held with a girl at a hotel in Dalgate on May 23, Monday pleaded for further investigation in the case. On 31 May 2018, police in the “status report” of the case had told the court that no case is made out against Gogoi and neither the hotelier nor the girl had filed any complaint.
The report was filed after the court of chief judicial magistrate Srinagar had asked police for status of the case following directions sought by rights activist Ahsan Untoo as to what police had done and why the accused army officer was set free.
“It may be a case of human trafficking and further investigation is needed to ascertain the facts,” advocate Bilal Ahmad Wani, counsel for complainant submitted before the court of chief judicial magistrate Srinagar.
“If we agree that it was an intimacy of two persons – the girl and Major Gogoi – what was the role of Sameer Malla. The police has not shown seriousness in the case,” advocate Wani submitted before the court, adding that the role of Malla should also be probed for bringing the girl from Budgam to Srinagar. “The investigation report which police filed before this court (CJM Srinagar) on 31 May 2018 is fishy. The role of Sameer Malla is suspicious which has not been touched (in police investigation). One of the aspects where police has not looked into is that it may be a case of human trafficking,” the counsel submitted before the court.
Advocate Wani further submitted that the court has inherit powers to direct police to go for further investigation “as police report cannot be treated as gospel of truth. The court has to look into the genuineness of the report”.
