No case is made out against army officer Leetul Gogoi who was held along with a girl when the duo tried to check into a hotel last week, according to a report police submitted in a court here on Wednesday.
The report was filed after the court of chief judicial magistrate Srinagar on Saturday asked police for status of the case when rights activist Ahsan Untoo sought directions as to what police had done and why the accused army officer was set free.
According to the status report, written in Urdu, no complaint was filed by the girl who had accompanied Gogoi to the hotel or by the hotel management. “The case was not found cognizable. The girl was handed over to the family while army officer Leetul Gogoi and his associate Sameer Ahmad Malla were handed to their army unit,” the police report said.
The report also mentions a statement of the girl recorded by a magistrate in which she has said, she was “with her friend Gogoi and there was no force involved.”The police report mentions the girl had come to hotel with Gogoi in a private car of Malla.
The incident on May 23 triggered an outrage as many alleged it amounted to sexual exploitation of a poor underage girl by a powerful army officer.Gogoi was earlier rewarded by the Indian Army chief for tying a civilian to the front of a military jeep for use a human shield against alleged stone throwers.
However, the police produced a letter from the girl’s school stating 13 October, 1998 as her date of birth.
“According to her Adhaar card, the age of the girl was above 18 but we checked it through other sources and found it to be true,” the report says. The court was informed by police they received information over phone about “a non-local man and a local girl had arrived in a hotel at Dalgate.” “An altercation broke out between the trio – Major Gogoi, Sameer Mala, and the woman – and the staff of the Hotel Grand Mamta after which they were driven to Khanyar Police Station. The altercation broke after the hotel denied them room. Gogoi had booked the room online,” the police status report said describing the incident, adding that due to an ensuing altercation some locals had also assembled in the hotel premises. “Keeping in view sensitivity of the matter and sentiments of public, the matter was looked into (by police).”
The case is not listed for hearing on 4 June, 2018.
